    I am really surprised that you guys are contemplating on going against your employer for a employment letter and filing your GC. I mean, how hard is it for you guys to agree to the terms of your employer that you will work till you get your GC and upto 6 months beyond that..

    If you guys came before 2001-2002 and seen how the situation was for green card filers you will now what I am talking about..

    1. There was no concurrent filing of I-140/485
    2. There was no premium processing for Labor
    3. There was no premium processing for I-140
    4. There was no AC-21, so there is no way of switching jobs..

    Still it used to take 4-5 years to get a GC.

    And you guys are complaining about your employer because you worked for 1-2 years and you want to quit as soon as you get EAD..

    Just imagine what would have happened if the dates were not CURRENT.. How many more years you would have worked, cursing USCIS

    Your greed will ruin you in future, just like you are cursing your employer's greed..

    Also, before you curse your employer, it was you who joined the company and you had many months to find out what kind of employer you have and it quit the company long time back.. You could have switched to different company long time back..


    I agree , and if the cost of leaving this stupid employer is just $10K, I would gladly pay and have some peace of mind.

    Also don't make decissions based on the current provisions/laws only. It is safe to assume you are going to be with your employer (who filed your GC) until you get your GC. You make a decision assuming that you can use AC21 after 6 months, but what happens if they remove AC21 in two months ??? People got burned when they assume status quo with the laws/provisions and they subsequently change.

    The problem will come, if you have an RFE for employment. If you get a letter from client, they will say that the company has employed, say for example Mr John as a Programmer Analyst for a period of 1 year. This will open up one major issue, that is you do not work for a company. The H1 and 485 is an application that is sponsored by a company, there is no clause for self sponsor. So when they see u are self sponsored, they could reject your 485.

    Something to chew over -- this is a Secretary of State who won't even admit to major blunders in Iraq, she is not about to admit they screwed up on this.

    but she's right. the US immigration law is extremely detailed and totally unforgiving. the country quotas being applied to employment visas looks like some lawyer gone overboard with putting constraints while writing the law, but now it is the law, and they don't change laws here unless there are votes or lot of money involved.

    that's the way it is written... you should have figured that out before coming here :(

    do you remember the case of the councilwoman who is about to be deported because she came to the US as a 1 year old and never got citizenship - and got elected/voted?

    now where will a person go after deportation, who came here when 1 year old?

    but she is screwed. the immigration law is totally unforgiving.

    BTW, for that poster who was imagining a single line, open your eyes buddy. There are indeed two lines. Higher qualifications gets you into the shorter one. You can fret and whine all you want but you cant change the fact.

    Porting PDs is a silly concept as others have pointed it out here. Its the law for now but wont be for long. Get over it.

    Did you know I-140 dates are prtable from X to Y after 140 is approved? I am sorry to hear your pain, but you can check if you can atleast maintain your priority dates.

    Are you sure about that...never heard of I140 portability. If it were true...why would there be such a big ho ha about AC-21.

    Iam a novice at this, and am by no means contradicting your point...just skeptical..

    I can more than understand what you are going through right now. I was diagnosed with cancer ten months after coming to the US. I am also the principal applicant and of course it was terrifying. I have no idea what your prognosis is or the type of cancer and do not need to know. However, I live in Indiana and the doctors here managed to save Lance Armstrong. He was sent here from Texas. I am now a six year survivor.

    I am now undergoing tests for a possible second cancer diagnosis seven years later and still no green card for my family. Hoping for one for my husband in the New Year. My son aged out and is on a student visa. I live each day realizing this is not a dress rehearsal and have to believe everything will be OK and I have absolutely no control over what the future holds.

    I know only too well how shell shocked you are right now but you have to have faith that things will work out how they are meant to. Adversity can have a silver lining.


    Wishing you all the best in your treatment plan. You need to concentrate on your health right now.

    People have been thinking that all along and have been lying motionless like a crocodile doing sunbath. USCIS have been retrogressing the Visas and at the same time consistently wasting Visa numbers every years. Shouldn't they have already been sued for that. We'll not do anything today just because it take 2-3 years. But what if they screw us again after 2-3 years. Dodn't you think we should keep fighting for injustice even if the benifit may not come to our generation but should pass to coming generation. If every body will become so much short sighted nobody would care for global warming, alternative eneryg options etc...
    if it takes 2 or 3 years to fight this case, what is the use

    My wife's 485/EAD/AP checks got cashed today. Biometric check not cashed yet. Although when I enter the receipt number in the USCIS website, couldn't find the case . :confused:

    All receipts number(from back of check) start with SRCxxxxxx, which means Texas i guess.

    All of us should be getting the receipts soon. Hang on.

    Dionysus,

    Mine was a EB2 India, Feb 2006 PD. I was hopeful in the month of august, but then I had lost hope because everybody was saying visa numbers got over. However, surprisingly they approved the case in September. Looks like CIS has many aces ups its sleeve. It never fails to surprise us.

    Also, I received only one soft LUD on my application, then suddenly it is card production ordered.. wow.


    Anyway, it FREEEEEEEEEEEEDOM...............


    Congrats buddy. Can you give some more info about your case please? Like the PD etc.

    Nothing at all about my US GC ... ( i just filed 485 about a year ago - this was about 3 months before that)
    These are approx conversations :)

    Why did you come here instead of home country ... i came here to do the landing, and thought i'll do the visa stamping as well + Regular employer/ job /education questions ...come back tomorrow to collect the passport

    Mine was same employer

    but u must ve mentioned on ur DS-156 that u ve filed GC ?

    Also did u take ur own car or rental Car?

    If country-cap is meant to promote diversity, it should be based on percentage of each ethnic group in US population. Indians and Chinese are a minority in this country.

    In that case, we should not have any caps.
